UPPER DARBY TOWNSHIP

There will be a Council Meeting of Upper Darby Township on Wednesday, June 15, 2022 at 7:00 p.m.  The meeting will be streamed to the public via YouTube live: https://www.youtube.com/upperdarbytwp. There will be a Public Hearing on proposed Ordinance No. 3116, followed by a vote and any other business that may come before Council at that time. A copy of the above-described Ordinance is available for review at the Township Building; on the Township website at https://www.upperdarby.org, and has been mailed to the Delaware County Daily Times and Delaware County Law Library. Copies of the Ordinance may be obtained for a fee not greater than the cost of copying. AN ORDINANCE AMENDING CHAPTER 550 ENTITLED “ZONING,” ARTICLE X, GENERAL REGULATIONS, SECTION 550-39, “FENCES” OF THE UPPER DARBY TOWNSHIP CODE PROVIDING FOR A MAXIMUM HEIGHT, PLACEMENT, MATERIALS, MAINTENANCE, VARIANCES, AND FEES FOR FENCES; REPEALING ALL INCONSISTENT ORDINANCES; AND PROVIDING AN EFFECTIVE DATE

The Ordinance amends the fence ordinance to add a 6' height limitation for fences on corner lots and provide guidelines regarding which materials may be used for both residential and nonresidential fences. The Ordinance provides the location of fences to be 1' behind the right-of-way line. This Ordinance also provides regulations for fences for swimming pools as well as prohibiting fences from dividing and/or encroaching too closely to shared driveways. The Ordinance also provides provisions for address temporary fences, maintenance requirements, nonconforming fences, a variance stipulation for any code relief, and a fee schedule for fence permitting.
