Property Resale

PLEASE NOTE: Beginning on January 1, 2025, Upper Darby Township will be performing INTERIOR inspections along with exterior inspections for all property resales. Please submit all resale applications along with payment at least 3-4 weeks prior to the settlement date to allow for inspections to be performed, necessary permits to be issued, and any violations to be corrected. 






The Upper Darby Residential Property Resale and Commercial Property Resale processes were established to protect property owners and their investment in Upper Darby. Any individual, entity, or corporation that owns real property within Upper Darby and desires to sell said property must first obtain a Resale Certificate from the Department of Licenses & Inspections as per Code 417-11 BBB



It is the responsibility of the sellers and their agent to ensure that a resale certificate has been issued before the transfer of any property an that the application is submitted in full, payment is made, inspections scheduled, violations corrected, permits get pulled, inspected and closed out

 

The Property Resale Process includes all provisions of the adopted Upper Darby Township Codes and shall apply to all existing residential and non-residential structures and all existing premises and constitute minimum requirements and standards for premises, structures, equipment and facilities for light, ventilation, space, heating, sanitation, protection from the elements, a reasonable level of safety from fire and other hazards, and for a reasonable level of sanitary maintenance, the responsibility of owners, and owner’s agent, operators and occupants; the occupancy of existing structures and premises, and for administration, enforcement and penalties. Additionally, the process shall include but not limited to the safety of public walkways and a sewer lateral inspection to protect the community from waste water flowing out of cracked and broken sewer lateral lines. It is important to start this process as early as possible.

 

  • Applications must be completed in full, including non-refundable payment, before inspections will be scheduled. Incomplete applications will be rejected and returned to the applicant. The application review process will not begin until all sections of the application are received and paid.  We require applications to be submitted at least 3 weeks for residential and 4 weeks for commercial properties prior to settlement in order to allow for inspections and work to be completed. 
  • All inspections must be completed, and any subsequent violations found must be corrected prior to the Resale Certificate being issued. Depending on the outcome of inspections, you may need to hire a licensed and insured contractor to fix any violations. Sewer Lateral Inspections must be performed by a plumber who is certified in Sewer Lateral Inspections by NASSCO or PHCC. Sewer Lateral certified and licensed plumbing contractors can be found at PHCC Certified Plumbers or NASSCO Certified Plumbers. Plumbers MUST include their NASSCO or PHCC number on the form or it will not be accepted. Sewer lateral inspections are good for 90 days from the date of the inspection.
  • Once all violations have been fixed by the seller, final inspections have been completed, all permits have been closed out, and any additional paperwork has been completed correctly, then a Resale Certificate will be issued. This typically takes 10-14 business days. 
  • If a property is being sold “as is” a Conditional Resale Certificate may be issued after a Buyers Acceptance Form is completed and notarized, and the fee paid. All violations must be corrected within one year of applying for the resale certificate or violations will be issued. Consecutive Conditional Resale Certificates will not be issued until the previous violations are corrected.

The Upper Darby Township Charter Part I, Chapter 417, Article II, § 417-11.BBB. CHAPTER 10, SALE OF PROPERTY

1002.3.1 Residential Properties (Less than three dwelling units).
  All residential properties being sold will have the following inspections performed:

  1. A full exterior and interior inspection of the property will be performed to determine compliance with applicable sections of this Code.
  2. Determine that the property has no open complaints, open permits, or outstanding liens or fees owed to the Township.
  3. A visual sewer lateral inspection and report as per Ordinance 3070 is required to be performed by an approved agency.

1002.3.2 Commercial Properties (Includes residential with more than three dwelling units).
  All commercial properties being sold will have the following inspections performed:

  1. A full exterior and interior inspection of the property will be performed to determine compliance with applicable sections of this code.
  2. Determine that the property has no open complaints, open permits, or outstanding liens or fees owed to the Township.
  3. A visual sewer lateral inspection and report as per Ordinance 3070 is required to be performed by an approved agency.

1003 Violations.
  All property violations discovered as per 1002.3.1 and 1002.3.2 hereof must be corrected before the resale certificate can be issued. If the seller of the property cannot correct all violations that are found on the property, a conditional resale certificate can still be issued under the following conditions:

  1. If the municipal inspection reveals at least one non-substantial violation, a conditional resale certificate/temporary use and occupancy certificate shall be issued.
  2. If the inspection reveals at least one substantial violation, the L&I Department shall specifically note those items on the inspection report and shall issue a temporary access certificate.
  3. All corrections must be made within 12 months from the date of the issuance of the conditional resale certificate/temporary use and occupancy certificate. An extension may be granted by the Director of the Licenses and Inspection Department subject to the Director's discretion. If corrections are not made within the designated time period, the Township will take the appropriate legal action to force the new owner to make said corrections.
